RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

If the athlete is 18 years of age or older, they must sign this release and waiver. If the athlete is under 18 years of age, a parent/guardian must sign this waiver and release on behalf of the minor.

I, the undersigned athlete/parent/guardian, understand that volleyball is a test of a person's physical and mental limits and carries with it the potential for property loss, minor injury, serious injury, and death. With a complete understanding of the potential risks, including but not limited to sprains, strains, fractures, concussions, collisions with equipment or other participants, risks associated with physical exertion, negligence of others, equipment failure, or facility conditions, I hereby assume the risks of participating/having my child participate in volleyball and training events, including lessons, clinics, workouts, practices, and any other related activities at The Net Jax Training Center LLC, located at 8168 Baymeadows Way West, Jacksonville, Florida 32256, including transportation to and from these activities and virtual sessions if applicable.

I, the athlete/parent/guardian, hereby take the following actions for myself, my executors, administrators, heirs, next of kin, successors, and assigns: (a) To the extent permitted by Florida law, I hereby waive, release, acquit, and forever discharge The Net Jax Training Center LLC and its officers, owners, directors, employees, agents, volunteers, contractors, affiliates, insurers, collectively and individually, adult supervisors, and any and all persons directly or indirectly associated with The Net Jax Training Center and each of them from any and all acts, causes of action, claims, demands, damages, costs, or expenses on account of or which may in any way develop out of any and all known and unknown personal injuries or property damages which the athlete/parent/guardian may suffer during the course of or as a result of using the volleyball court located at 8168 Baymeadows Way West, Jacksonville, Florida 32256 for lessons, clinics, workouts, and other activities, and travel to and from these activities; (b) I agree not to sue any of the persons or entities mentioned above for any claims made or liability assessed against them as a result of my/my child's actions.

If the athlete is under 18 years of age, I hereby acknowledge that I am the lawful parent and/or guardian of the minor. As the parent/guardian, I represent that I have the authority to bind the minor to this agreement, understanding that certain claims may not be waivable under Florida law. In the event my child becomes ill or sustains an injury, I hereby authorize The Net Jax Training Center LLC or its representatives to obtain emergency medical/dental care, including transportation to a medical facility if necessary. I will assume financial responsibility for any bills incurred and agree to indemnify The Net Jax Training Center LLC for any costs associated with providing such care.

Photography/Video Release

Athletes involved in any activities offered by The Net Jax Training Center LLC may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on The Net Jax Training Center website or in any editorial, promotional, or advertising material produced and/or published by The Net Jax Training Center.

Health and Safety Acknowledgment

All participants in activities at The Net Jax Training Center must agree to and abide by any applicable health and safety guidelines from the Florida Department of Health regarding infectious diseases. By signing this agreement, I acknowledge the potential risks associated with infectious diseases and voluntarily assume those risks for myself and/or my child(ren).

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless The Net Jax Training Center LLC, its employees, agents, and representatives, of and from any claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto.

Severability: If any provision of this agreement is held to be invalid or unenforceable, the remainder of this agreement shall remain in full force and effect.

Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of Florida.

Acknowledgment: I have carefully read this entire agreement, fully understand its terms, and voluntarily sign it without any inducement.
